General Terms and conditions in
Boardinghaus Freising (“BHF”), Bahnhofplatz 7+7 b, 85354 Freising


I. Scope

  1. These terms apply to all assignments of rooms, apartments and flats for accommodation and related services. The unhooking the house rules are part of the GTC.
  2. These terms and conditions apply exclusively. Opposing or deviating from this business conditions of the guest /contractor will not be accepted, unless these are previously expressly agreed in writing.

II. Conclusion of contract

  1. Reservations can be made by the guest /contractor in writing, via voice, by telephone, by e-mail or fax.
  2. The contract is concluded with the acceptance by BHF. BHF confirms this to the guest / contractor in writing, by e-mail or fax. The inquiry to prolong the booking have to happen by contractor/guest.

III. Principle

  1. The maximum occupancy is six months. An extension of a booking is possible upon availability, a claim does not exist.
  2. In all rooms/ apartments/ flats BHF have right of access to maintain the regularity of the layout and cleanliness of the premises.
  3. A sub-letting of rooms / apartments / flats are excluded. The allocation of rooms / apartments / flats with more than the number of booked people, the prior written consent by BHF can be needed.
  4. Gross or repeated violations of house rules with two-time warning can result into immediate termination of the lodging contract.
  5. There is an absolute ban on smoking in all rooms. In case of violation to the guest / contractor can be charged special cleaning service (based on cost 30 € / hour) and/ or a renovation package (200 €).
  6. Pets are not allowed.
  7. Abandoned private property protects the BHF four weeks after return of the rooms / apartments / flats. After the deadline, the BHF has the right, to dispose or to transfer the forgotten private property to a lost property office without claim for compensation.
  8. Unreturned keys and damaged furniture will be charged.
  9. Restricted opening times of the reception: Mon-Fri: 8.00-11.00 am and 5 – 7 pm, Sat 9-10 am, Sundays and public holidays closed.

IV. Check-in, Check-out, preparation

  1. Reserved rooms / apartments / flats are available to the guest on day of arrival not later than 1pm.
  2. Key issue at check-in happens basically out of the key box. The required code was forwarded to the guest with the booking confirmation or he can get it by BHF-Hotline +49 (0) 176/2003 13 53 (Mon – Fri. 8 am – 7 pm, Sat 9 am – 12 am).
  3. The BHF is committed to have the booked rooms / apartments / flats and to provide the agreed services. Unless otherwise agreed, there exist no claim of certain rooms / apartments / flats. Moreover, the specification is from the booking confirmation.
  4. If the promised rooms / apartments / flats according to booking confirmation are not available, then BHF make a suitable replacement in the house. Further claims of the score are excluded.
  5. The guest on his arrival is obliged to identify themselves and fill out completely the check-in form with his personal details and sign.
  6. Departures have to be no later than 10 am: For use the rooms / apartments / flats on departure after 10:00 clock, BHF calculates in the case of using a) till 6pm with 50% of the price, b) from 6 pm on with 100% of the price.

V. Prices

The agreed prices include applicable sales tax. If, after the completion of the accommodation contract will be an increase of sales tax, it´s valid the tax rate at the time of using the room.


VI. Payment

  1. BHF is entitled to receive a deposit to make a binding booking of rooms / apartments / flats. Payments required by BHF each are to pay till specified time of BHF.
  2. The lodging fees are payable latest with arrival of the guest.
  3. Payment condition
    Inland
    • booking up to 14 nights: complete in advance
    • booking more than 14 nights: 60% deposit of the cost (maximum from 1 month, desposit back with final voice)
    • on day of check-in: monthly in advance
    Foreign country
    • booking up to 1 month: complete in advance
    • booking more than 1 month: 60% deposit of the cost (maximum for 1 month, deposit back with final invoice)
    • on day of check-in: monthly in advance
  4. Accepted payment methods: cash, bank transfer (possibly with the proof of payment = account statement), EC, VISA, MASTER CARD, PayPal.

  6. Late payment may result in immediate termination of the accommodation contract, if BHF this has notified to contractor/guest within a reasonable period for payment.
    • Upon default, BHF calculate at the lagging amount an interest rate at of 8 percentage points above the base rate p.a.
    • For every reminder BHF calculates a fee of € 5.00.
  7. If contractor is not the guest at same the time, so contractor and guest are liable to BHF as joint and several debtor for the obligations of the booking.

VII. Right of withdrawal, cancellation, no show by the guest contractor

  1. The guest/contractor at any time may cancel the booking before departure and / or during the stay. The guest/contractor is recommended to declare the cancellation in writing.
  2. In case of cancellation, BHF charges cancellation fees. Relevant for the calculation of fees is the receipt of the cancellation statement in BHF.


    2.1. Single-booking
    Room rate for the actual stay and following cancellation fees:

    10 % of cancelled period, maximum of 30 nights, minimum 50,00 €
    for (partial) withdrawal BEFORE arrival / no show – cancellation more than 30 nights BEFORE arrival
    for (partial) cancellation DURING stay – Cancellation with departure more than 30 days later

    20 % of cancelled period, maximum of 30 nights
    for (partial) withdrawal BEFORE arrival / no show – cancellation more than 22-29 nights BEFORE arrival
    for (partial) cancellation DURING stay – Cancellation with departure 22-29 nights later

    30 % of cancelled period, maximum of 30 nights
    for (partial) withdrawal BEFORE arrival / no show – cancellation more than 15-21 nights BEFORE arrival

    40 % of cancelled period, maximum of 30 nights

    50 % of cancelled period, maximum of 30 nights

    2.2. Calculation for group booking
    With cancellation 1-3 objects there are valid the withdrawal terms for single-booking; with cancellation 4 objects and more, room rate for the actual stay and following cancellation fees per object:

VIII. right to cancel the contract by BHF

  1. If there is no settlement of deposit /advance payment /payment, even after a reasonable grace period setted by BHF, BHF has the right to cancel the contract.
  2. BHF is entitled to withdraw from the contract for materially justifiable cause, especially if: a) act s of nature beyond control or other circumstances that not allow the fulfillment of the contract; b) the booking of rooms/apartments /flats was done with misleading or false statements of essential facts, p.e. in the person of the customer; c) the guest transfer to use the rooms/apartments/flats to a third person without the consent of BHF; d) if the guest, despite a warning by BHF, disturbs other guests, the accommodation facility or rather the security and reputation of BHF in the public or he is contrary to contract to such an extent, that the immediate cancellation of the contract is justified.
  3. Announces BHF the accommodation contract in accordance with Item 2, it reserves the right to the rent.
  4. In a justified withdrawal of BHF the customer does not entitle for damages.

IX. Liability

  1. Liability under § 536 a BGB is excluded.
  2. As far as the guest is provided a parking space on the grounds of the BHF, even if a charge is made, a) BHF does not take care for the parked vehicle and the objects stored therein. A safekeeping is not materialized; b) BHF is not liable on the property for loss or damaging of parked or backed motor vehicles and their contents, except that BHF or his employees the damage caused by gross or intentionally negligence.
  3. BHF is not liable for the consequences of unlawful use of a provided internet access, especially for an illegal download of content. The contractor/guest releases BHF of any resulting from claims by third parties.
  4. For financial losses of the guest BHF is liable only for willful misconduct or gross negligence. Different, BHF is liable for financial damages for simple negligence, unless the BHF has culpably violated an essential contractual obligation, in which case the liability for damages is limited to the foreseeable damage typically occurring

X. Severability clause 

  1. If single regulations, including the general terms and conditions, are ineffective, the effectiveness of the remaining regulations will not be affected.
  2. The parties will replace the remaining regulation with effective ones, which approach to their intention and their economic relevancy, immediately.

XII. Final clause

  1. Place of delivery and place of payment is Freising.
  2. German law applies.
  3. Court of jurisdiction for any disagreements of both parties, resulting from the constructional relation is Freising.
  4. If there are mistakes in the translation the German version is the valid basis.
